WESTERBEKE / UNIVERSAL WARRANTY

Westerbeke Corporation warrants that the following products and their parts will be free from defects in material, design and workmanship from their original date of purchase through the following coverage periods, subject to the general limitations and exclusions set forth below:

A. PRODUCTS COVERED

Universal and Westerbeke Marine Propulsion Engines with a date of manufacture after July 17, 1990.

B. PERIODS AND EXTENT OF COVERAGE

  1. Products purchased by a consumer and at all times used, in pleasure craft for personal and family use are covered for a period of one (1) year from the original date of purchase.  All parts (other than those parts excluded below), and labor, travel, transportation, removal and re-installation expenses (each limited below), are covered during such period.  All warranty service is limited to service which is performed within the continental United States and Canada.
  2. Products used at any time in commercial, charter, rental, leasing, and other such applications are warranted for a period of one year or 1500 hours, whichever occurs first.  All parts (other than those parts excluded below); and labor, travel, transportation, removal and re-installation expenses (each limited below), are covered during such period.

C. GENERAL LIMITATIONS AND EXCLUSIONS   FROM COVERAGE

  1. Expenses Covered and Their Limitations
    a.
      Labor expense coverage is limited to the labor time allotted for the applicable service from the most recent flat rate time schedule at Westerbeke's most recently approved regional hourly labor rate in effect.  The applicable flat rate time schedule and approved regional hourly labor rate are available at each Westerbeke Master Distributor and may be amended by Westerbeke from time to time without notice. 
    b. Travel mileage expense coverage is limited to a total of 150 miles at Westerbeke's approved mileage rate in effect, Labor time coverage relating to travel is limited to a total of two hours.
    c.Transportation expense coverage is limited to standard methods of transportation such as truck, sea, rail, UPS and parcel post one-way.  Premium transportation charges, such as air freight, are not covered.
    d. Removal and re-installation labor time expense coverage is limited to a maximum of 4 hours for 2 and 3 cylinder engines and 6 hours for 4 cylinder engines.  These time limitations do not include labor time associated with difficult access to the product or preparation tasks such as moving furniture and carpets, all of which are expressly excluded from coverage.

  1. Other Exclusions From Coverage
    Coverage under this warranty shall not apply to, among other things:
    a. Product failures or damage caused by the user's failure to follow the installation, operation and other instructions found in the written materials provided with the product, including, for example without limitation, failures, and damage caused by (i) inadequate or improper installation, start-up, operation, use, maintenance, adjustments, or storage; (ii) defects in the system or application in which the product is installed or used; (iii) water intrusion of any kind; (iv) excessive cranking which in conjunction with water-lift type exhaust systems causes water intrusion of starter failure; (v) the use of improper, poor quality or contaminated fuel; (vi) the use of non-Westerbeke factory supplied or approved parts; or (vii) the failure to heed safety warnings such as (to the extent applicable to the particular product) low oil pressure, high water temperature, high exhaust temperature, over speed or the non-operation of corresponding safety shutdowns.
    b. Failures or damage caused by accessories attached to the product.
    c. Failures or damage caused by folding or featuring propellers.
    d. Damage occurring in transit after the product leaves Westerbeke's factory.
    e. Parts requiring replacement due to their normal wear and tear.
    f. Parts and other items normally replaced during during routine maintenance and tune-ups, such as (to the extent applicable to the particular product) ignition and carburetor components, belts, hoses, clamps, filters, zinc anodes, gaskets, seals and consumable fluids.
    g. Products which have been altered or modified from their standard configuration in a manner not authorized by Westerbeke Corporation in writing.
    h. Parts installed or repaired by an unauthorized service person.
    i. Products specially manufactured or configured to meet customer specifications.
    j. Expenses relating to (i) communication, such as telephone, telegraph, telex, or telefax; (ii) living and travel, such as meals, lodging, and tolls; (iii) rental of equipment or any other item; (iv) use of consumable parts and consumable fluids such as lubricating oil, coolant, lubricants, paint and similar items; (v) towing charges, dockage, storage, crane fees, captain's fees and othere similar services; and (vi) inconvenience or loss of time or income.
  2. Other Restrictions
    a. All claims must be brought to the attention of Westerbeke Corporation or it's authorized service representative within thirty (30) days after discovery that any product falls within the coverage afforded by this warranty. 
    b. All warranty service must only be performed by a Westerbeke authorized service representative to whom you have been referred by your nearest Westerbeke Master Distributor.  Please refer to the warranty service procedures section set forth below.
    c. Any parts replaced under this warranty are warranted only from the original date of purchase of the warranted product of which they are part. 

PRODUCT REGISTRATION
WESTERBEKE REQUIRES AS A PRE-REQUISITE TO WARRANTY COVERAGE HEREUNDER THAT THE ORIGINAL OWNER COMPLETE AND RETURN TO WESTERBEKE THE REGISTRATION CARD PROVIDED WITH THE PRODUCT.  Upon Westerbeke's receipt  of the registration card, Westerbeke will send the owner an official customer identification card, the use of which will be required for the processing of any warranty service matters in the future.  WARRANTY COVERAGE HEREUNDER WILL NOT BE AFFORCED TO ANY SUBSEQUENT OWNER UNLESS SUCH OWNER APPLIES FOR A CUSTOMER IDENTIFICATION CARD BY CONTACTING WESTERBEKE CORPORATION AT THE ADDRESS SET FORTH BELOW.  Westerbeke reserves the right to require the payment of a reasonable application and processing fee to be submitted with such subsequent owner's application for a customer identification card.

WARRANTY SERVICE PROCEDURES AND REMEDIES

A. SERVICE PROCEDURES

  1. Locate your nearest Westerbeke Master Distributor authorized to service products from the directory provided with your.  In your local telephone directory or by contacting the Customer Service Department at the address set forth below.

  2. Contact this Westerbeke Distributor and request warranty service.  Be prepared to furnish the following information:
    a. Owner's name, address, business, and home telephone numbers.
    b. Model and serial number
    c. Date of purchase
    d. Boat model, the name of the boat, and the present location of the boat or product.
    e. Name and address of the boat manufacturer.
    f. Description of the current problem.
    g. The name of any service outlet previously contacted and their diagnosis.
    h. Information regarding any prior problems, servicing or installation.
    The Master Distributor will identify an appropriate authorized service representative for you to contact.

  3. Contact this authorized service representative and make arrangements to have warranty service performed.

  4. At Westerbeke's election, appropriate repairs or replacements will be furnished if, upon Westerbeke's or it's authorized representative's inspection, the product falls within the coverage afforded by this warranty

Westerbeke's sole liability and the owner's sole remedy for a failure of any product under this warranty and for any and all other claims arising out of the purchase and use of any product shall be limited to the repair or replacement of the product or its applicable parts by Westerbeke Corporation or by its authorized representative under the terms of this warranty.  Any provision of this warranty which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof or affecting the validity or enforceability of such provision in any other jurisdiction.

THIS WARRANTY IS IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS AND MERCHANTABILITY, AND THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF, ANY WARRANTY IMPLIED BY LAW, IS IN EFFECT ONLY FOR THE DURATION OF THE EXPRESS WARRANTY SET FORTH HEREIN, NO REPRESENTATIVE OR PERSON IS AUTHORIZED TO GIVE ANY OTHER WARRANTY OR TO ASSUME FOR WESTERBEKE CORPORATION ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OR SERVICE OF ITS PRODUCTS.  WESTERBEKE CORPORATION WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING WITHOUT LIMITATION THOSE SPECIFIED HEREIN) RESULTING FROM THE INSTALLATION, OPERATION OR USE OF ITS PRODUCTS, SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSIONS OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS , AND YOU MAY ALSO HAVE OTHER RIGHTS WITH VARY FROM STATE TO STATE.
